Appeal Revokes Court’s Decision on CDF’s Client Property Arrest

On August 30, the appeals instance of Saint Petersburg City Court revoked the court of the first instance decision on arresting 2 378 property items of a CDF’s client net over 8.7 bn rubles.

CDF Partner Artyom Polovinkin noted, ‘Despite the fact that the prosecution is being conducted against specific subjects accused of fraud and creation of a criminal community following the investigation’s request (artificially filed in different district courts to hinder the verification of proportionality requirements), the arrest orders were imposed on all the property of a client, a legal person, including the abovementioned property items and non-cash funds on the bank accounts. This was once again done to violate the priority of the property arrest, as well as the requirements of seizure of property commensurate with the amount stolen.’
